These Terms of Service apply to the Take the Punch™ website and services provided by Sunday Girl LLC. By using this website or purchasing a service from Take the Punch™, you agree to these terms.

THE OPERATIONAL SURVIVAL CHECKUP™

The Operational Survival Checkup™ is a focused assessment of the part of your business you most need to keep running when technology goes down.

The scope of each Checkup is established before the work begins. The fixed-scope $495 Checkup is intended for situations where one owner or manager can reasonably explain the part of the business being examined and how it works.

If the work involves multiple teams, locations, handoffs, systems, or decision-makers, a separately scoped engagement may be required.

WHAT THE CHECKUP PROVIDES

For the agreed scope, the Checkup includes information gathering, a working session, analysis, a practical Plan B, the Top 3 things I'd fix first, and a written Checkup report.

The Checkup is based on the information reasonably available at the time of the engagement. The recommendations reflect my professional judgment based on that information.

CLIENT RESPONSIBILITIES

You are responsible for providing accurate and reasonably complete information about the part of your business being examined.

You remain responsible for business decisions, implementation of recommendations, employee safety, regulatory obligations, legal requirements, cybersecurity controls, technology recovery, and the operation of your business.

You should independently evaluate recommendations before making changes that could affect safety, security, legal obligations, finances, customers, employees, or business operations.

NO GUARANTEE OF CONTINUITY

Technology disruptions and business operations involve circumstances that cannot always be predicted or controlled.

The Checkup can identify problems and provide a practical Plan B based on the information available at the time. It cannot guarantee that your business will remain operational during every disruption or that a particular Plan B will work under every circumstance.

NOT AN IT RECOVERY OR CYBERSECURITY SERVICE

Unless specifically included in a separate written scope, Take the Punch™ does not provide managed IT services, system recovery, incident response, penetration testing, cybersecurity monitoring, legal advice, insurance advice, engineering services, or implementation of technical controls.

The Operational Survival Checkup™ focuses on helping your business prepare to keep an important part of the business running while technology is down.

CONFIDENTIAL BUSINESS INFORMATION

Please do not provide passwords, authentication credentials, encryption keys, regulated personal information, or other information that is not reasonably necessary for the engagement.

Information provided for an engagement will be used to perform the requested services and manage the business relationship. Additional confidentiality requirements may be documented separately when appropriate.

FEES, PAYMENT, AND SCHEDULING

Fees and scope will be communicated before an engagement begins.

Unless otherwise agreed in writing, payment is due before the scheduled working session.

If you need to reschedule, please provide reasonable notice. Specific cancellation, rescheduling, or refund terms may be provided at the time of purchase or scheduling and will control if they differ from this section.

INTELLECTUAL PROPERTY

Take the Punch™, the Operational Survival Checkup™, and the methods, frameworks, questions, templates, tools, training materials, report structures, and other proprietary materials used to provide the service are owned by Sunday Girl LLC or used with permission.

Purchasing a service does not transfer ownership of these materials or grant permission to reproduce, teach, license, resell, publish, or commercially use the methodology.

You may use your completed Checkup report and recommendations internally for your own business purposes.

THIRD-PARTY SERVICES

This website and our services may rely on third-party platforms for website hosting, communications, scheduling, payment processing, analytics, or other functions.

We are not responsible for the availability, security, policies, or performance of third-party services outside our reasonable control.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Sunday Girl LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of this website or services.

To the fullest extent permitted by applicable law, Sunday Girl LLC's total liability arising from a particular paid service will not exceed the amount paid to Sunday Girl LLC for that service.

Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply in every situation.

Information on this website is provided for general informational purposes and may change as Take the Punch™ services develop.

We make reasonable efforts to provide accurate information but do not warrant that website content will always be complete, current, or error-free.

These Terms are governed by the laws of the State of Alaska, without regard to conflict-of-law principles.
